This document provides information on how JUDr. Jiří Janoušek, Attorney-at-Law, his employees and attorneys-at-law with whom he cooperates on a permanent basis process personal data in connection with the provision of legal services, the operation of the website www.janousekadvokat.cz and other related activities, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Czech Act No. 110/2019 Coll., on Personal Data Processing.

1. WHO PROCESSES YOUR PERSONAL DATA

The controller may cooperate with other persons listed in the “OUR TEAM” section of the website www.janousekadvokat.cz. These persons provide legal services or perform other activities for the controller, including administrative activities. They primarily include attorneys-at-law cooperating with JUDr. Jiří Janoušek, Attorney-at-Law, on a permanent basis and his employees. Where personal data are processed by employees, such processing is carried out under the responsibility of JUDr. Jiří Janoušek, Attorney-at-Law, as the controller.
To the extent that legal services are provided by attorneys-at-law cooperating with the controller on a permanent basis, such attorneys-at-law may act as separate controllers in relation to the personal data processed in connection with the provision of legal services and related activities.

2. WHY WE PROCESS YOUR PERSONAL DATA (LEGAL BASES AND PURPOSES OF PROCESSING)

We process your personal data only to the extent necessary for the following purposes:
• Performance of a contract [Article 6(1)(b) GDPR]: Processing is necessary for entering into and performing a contract for the provision of legal services or in order to take steps at your request prior to entering into such a contract.
• Compliance with legal obligations [Article 6(1)(c) GDPR]: Processing is necessary for compliance with obligations imposed on us by applicable legislation, in particular the Czech Legal Profession Act, tax and accounting legislation, statutory archiving requirements and Czech Act No. 253/2008 Coll.
• Legitimate interests [Article 6(1)(f) GDPR]: We process your personal data for the purposes of protecting our rights and legal claims in the event of a dispute, recovering outstanding claims and presenting client references, including the use of publicly available reviews.
• Consent to processing [Article 6(1)(a) GDPR]: On the basis of your freely given consent, we process personal data for the purposes of sending commercial communications and newsletters and for the use of analytical and marketing cookies on our website, in accordance with the consent provided through the cookie banner.

3. CATEGORIES OF PERSONAL DATA PROCESSED

We process, in particular but not exclusively, the following categories of personal data:
• Identification data, such as your first name, surname, date of birth or personal identification number;
• Contact details, such as your address, email address or telephone number;
• Data relating to the client’s case or legal instruction, including information and documents provided to us or obtained by us in connection with the provision of legal services.

4. RECIPIENTS AND PROCESSORS OF PERSONAL DATA

We take the protection of your personal data seriously and observe the statutory duty of professional secrecy applicable to attorneys-at-law.
Your personal data may, to the extent necessary, be disclosed to:
• Public authorities, where such disclosure is required by law or is made in connection with the provision of legal services.
We also use personal data processors, including:
• Operators and maintenance providers of the law firm’s information systems and providers of accounting services;
• ECOMAIL.CZ, s.r.o., where you subscribe to our newsletter;
• Providers of analytical and marketing tools, including Google Analytics and Google Search Console, where you have consented to the relevant cookies on our website.
Your personal data will not be transferred to third countries without your consent unless compliance with Chapter V of the GDPR has been ensured.

5. NEWSLETTER

Where you voluntarily subscribe to our newsletter through our website, you consent to the processing of your personal data for this purpose.
We send newsletters no more than twice a month. They contain exclusively links to our blog articles, legal updates or information about seminars.
You may unsubscribe at any time and free of charge by clicking the unsubscribe link in the footer of each email or by sending a request to office@janousekadvokat.cz.

6. CLIENT SATISFACTION RATINGS AND REVIEWS

Where you decide to publish a review of our services on a social media platform or search engine platform, in particular as a Google review, you do so voluntarily, and the processing of your personal data is governed by the terms and conditions of the relevant platform.
On the basis of our legitimate interests, we may reproduce such publicly available reviews verbatim on our website as client references.
Should you no longer wish your review to be displayed on our website, please contact us, and we will remove it without undue delay.

7. COOKIES

Our website uses cookies.
Strictly necessary cookies required for the proper functioning of the website are processed on the basis of our legitimate interests as technical cookies.
Analytical and marketing cookies are processed only on the basis of your consent, which you provide through the cookie banner on our website. You may change or withdraw your consent at any time through the cookie banner.

8. RETENTION PERIOD

We process personal data for the duration of the contract for the provision of legal services and for as long as your consent, our legitimate interests or our applicable legal obligations remain in effect.
In relation to archiving and retention periods, we comply with applicable legislation, in particular the Czech Legal Profession Act, legislation governing archives and records management, anti-money laundering legislation and tax legislation.
Personal data used for sending newsletters are processed until you unsubscribe from the newsletter or withdraw your consent.

9. YOUR RIGHTS UNDER THE GDPR

• Right of access: You have the right to obtain information about the personal data we process concerning you and to receive a free copy of such data.
• Right to rectification and completion: You have the right to request the rectification of inaccurate personal data and the completion of incomplete personal data concerning you.
• Right to erasure (“right to be forgotten”): You have the right to request the erasure of personal data where the purpose of the processing no longer applies or where you withdraw your consent. Please note that this right may be restricted by our statutory obligations, including mandatory retention of the client file.
• Right to restriction of processing: In the circumstances specified in Article 18 GDPR, you have the right to request that the processing of your personal data be restricted.
• Right to data portability: You have the right to receive your personal data in a structured and machine-readable format and to transmit those data to another controller, provided that the processing is carried out by automated means and is based on a contract or your consent.
• Right to object: You have the right to object at any time to the processing of personal data based on our legitimate interests.
• Right to lodge a complaint: If you believe that your personal data are being processed in breach of applicable legislation, you have the right to lodge a complaint with the competent supervisory authority:

The exercise of your rights may, in individual cases, be restricted by the statutory duty of professional secrecy under the Czech Legal Profession Act.
We will respond to your request concerning the exercise of your rights without undue delay and no later than within one month of its receipt.
Appropriate organisational and technical measures have been implemented in accordance with applicable legislation to ensure a level of security appropriate to the nature, scope, context and purposes of the processing and to the risks associated with such processing.
Where your request is submitted electronically, we will also provide our response electronically, unless you request another means of communication.
